Following a prior court victory, Montgomery County local gun bill 21-22 will not stand after recent judgement.
A Montgomery County Circuit Court Judge, Ronald B. Rubin, handed down a permanent injunction blocking portions of a local law in Montgomery County that would have restricted the carrying of firearms in public. The crux of the ruling is that a political subdivision in Maryland cannot prohibit, except for a very narrow band of activity, what is intentionally permitted by state law. This is the second ruling in a matter of days to restrain gun laws intending to extend restrictions beyond what is permissible according to the Bruen decision and existing Maryland gun laws.
"In the court's view, and as counsel for the county conceded at oral argument, the county wanted, among other things, to largely eliminate the state granted right to wear and carry a firearm in the County, even when the individual held a state issued concealed carry permit," Rubin wrote.
As previously covered on the Conduit Street blog, Anne Arundel is also in the midst of defending a local ordinance concerning gun sales. Oral arguments were heard on December 8th, and a decision is forthcoming in that case - Maryland Shall Issue Inc et al. v. Anne Arundel County, MD concerning local council bill 108-21. The legislation would require gun retailers in the county to distribute pamphlets created by the Anne Arundel County Health Department that offer information regarding suicide prevention, mental health, non-violent conflict resolution, and gun safety. Gun retailers are expected to display and distribute the literature with gun purchases under this law.
