If you get the pending contract substituted by another contractor because of unnecessary delays by the contractor to complete the last part of work for more than a month because of which your work also suffered, you get the AMOUNT given to another contractor PLUS the compensation for the DELAYS caused.
If you have the signed receipts of the money given at different intervals (except the last amount kept to be given at the completion of contract performance) and the chronology of the work done at different times, then it gets easier to get the compensation.
PS- CONTRACTS CAN BE ORAL TOO AND THEIR TERMS CAN BE SET A LITTLE LATER THAN THE TIME THE EARNEST MONEY IS GIVEN. AND IF YOU HAVE A THIRD PARTY AS A WITNESS, THEN YOUR CASE BECOMES CERTAINLY STRONGER.
