The ban, initially imposed in 2005 saw a long legal struggle between the State and the Judiciary with the bar dancers stuck in the middle of the struggle. Finally, in 2016, the Supreme Court declared the ban unconstitutional and upheld the fundamental rights of the bar dancers. This article analyzes the implications of the ban, the arguments presented by both sides and the situation of marginalized communities in India.
