الملخص :

إذا كان الأصل أن الاختصاص القضائي في منازعات صفقات الجماعات الترابية، يدخل في إطار القضاء الشامل، على اعتبار أن الصفقة عقد إداري يبرم بين صاحب المشروع وبين المقاولة المكلفة بتنفيذ عقد الصفقة، فالممارسة العملية أثبتت صراحة تدخل قاضي الإلغاء كذلك في هذا الإطار عن طريق نظرية القرارات المنفصلة، حيث أضحت مدخل اساسي يقوم من خلاله قاضي المشروعية ببسط رقابته على هذه الأعمال التمهيدية، لإبرام عقد الصفقة، وقد اتسعت سلطات قاضي الإلغاء لتشمل مرحلة التنفيذ كذلك، من خلال مراقبته لجميع الأعمال التي يتخذها صاحب المشروع في إطار التوجيه والمراقبة خلال هذه المرحلة، حيث يقوم بمراقبة مدى مطابقة هذه الأعمال لمبدأ المشروعية، وهو توجه حديث –قاضي الالغاء ومرحلة تنفيذ عقد الصفقة- لا زال في بدايته ويعرف نوعا من الاحتشام والرفض وقد ترجمت ندرة العمل القضائي في هذا السياق ذلك، ولعل ما يبرر هذا الطرح رغبة المقاول خلال مرحلة التنفيذ سلوك مسطرة القضاء الشامل، نظرا لما يوفره هذا الأخير من حلول تفضي في غالبية الأحيان الى التعويض، والجدير بالذكر أن سلطات قاضي الإلغاء باتت اليوم تشمل جل مراحل عقد الصفقة في محاولة منه اقرار نوع من التوازن في العلاقة بين طرفي العقد.

Abstract

If judicial competence as the base of territorial authorities disputes falls within the framework of inclusive judiciary, considering that the deal is an administrative contract concluded between the owner of the project and the contractor entrusted with the implementation of the deal contract, then the practice has explicitly proven the intervention of the judge of abrogation in this framework as well through the theory of discrete decisions, as it has become the basic entry by which legitimacy judge extends his control over these preliminary works, to make the deal contract. Besides, the authorities of the abrogation judge, has expanded to cover the implementation phase as well, by monitoring the tasks taken by the project owner as a part of the framework of guidance and control during this stage, as he surveys the extent to which these actions comply with the principle of legitimacy. It is (the judge of abrogation and the deal contract implementing phase) a new orientation method that is still in its beginnings and knows a kind of modesty and refusal, and the scarcity of judicial work in this context has shown that, and perhaps what justifies this proposition is the contractor's desire during the implementation phase to take inclusive judiciary procedures, due to the solutions provided by the latter that often lead to damages. it is worth saying that the abrogation judge authorities nowadays include almost all phases of the deal contract in an attempt to establish a kind of balance between contract parts.
