Un piège béant. Les activités de cloud en Europe souffrent d'un manque d'autonomie stratégique, dénonce Peter Carl Mogens. Nous sommes à la merci des grands fournisseurs.
Certaines voix soutiennent que nous n'avons pas besoin d'une infrastructure cloud européenne, regrette Peter Carl Mogens dans Euractiv. Ex Director General, DG Environment, European Commission, aujourd'hui consultant stratégique, il voit dans cette attitude un terrible danger.
« Cela semble trop familier. Les mêmes erreurs ont été commises ces dernières années en se fiant naïvement à des approvisionnements russes 'fiables' en gaz ou à des importations bon marché de panneaux solaires et de semi-conducteurs chinois au détriment de la production nationale de biens stratégiques. Pendant la pandémie de Corona, l'externalisation des produits pharmaceutiques et d'autres produits de santé clés vers les pays asiatiques nous a fait réaliser à quel point nous dépendons des fabricants non européens… »
Le cloud, « démocratiseur »
Les mêmes erreurs se répètent-elles dans l'économie numérique ? Et, d'abord, que signifie « autonomie stratégique » dans le contexte d'une infrastructure cloud européenne ?
Pendant longtemps, le cloud a été considéré comme un « démocratiseur ». Il est ouvert, flexible et relativement peu coûteux. Cela lui permet de changer des industries entières et de favoriser la croissance. « Cependant, les clients ne peuvent souvent pas utiliser un logiciel déjà sous licence dans l'infrastructure cloud de leur choix, observe Peter Carl Mogens. Des pratiques trop familières dans l'économie numérique les en empêchent. Les fournisseurs de logiciels qui dominent le marché utilisent des conditions de licence restrictives archaïques mais très efficaces telles que le regroupement, le couplage, la tarification auto-préférentielle et les liens technologiques et économiques afin d'installer un nombre croissant de clients européens dans leurs infrastructures cloud. »
Pour mettre fin à cet abus, l'association européenne CISPE (Cloud Infrastructure Service Providers in Europe) a récemment déposé une plainte antitrust de l'UE contre Microsoft -bien que certains membres craignent des représailles. « Des sources confidentielles m'ont confirmé qu'un seul contrôleur logiciel peut fermer la moitié de votre entreprise en un seul clic ! »
La peur de représailles
« Encore une fois, cette affirmation me semble trop familière, poursuit Peter Carl Mogens. Lorsque j'étais responsable des restrictions commerciales contre la concurrence étrangère déloyale à la Commission européenne, la peur des représailles était une raison courante pour laquelle même les grandes entreprises européennes ne se plaignaient pas des stratégies de dumping chinoises ou des subventions déloyales de l'État. La domination de quelques-uns ou d'un seul contrôleur logiciel est devenue si importante qu'il faut agir avant qu'il ne soit trop tard. »
Mais comment agir ? Comment éviter de perdre notre secteur des infrastructures cloud et de devenir numériquement impuissant ? Nous avons besoin de concurrence, de variété, de diversité et de respect du mode de vie européen. Ces objectifs doivent être non négociables. Les éditeurs de logiciels dominants ne doivent pas être autorisés à continuer d'utiliser des pratiques de licence déloyales et faussant la concurrence. Cinq mesures complémentaires le garantissent.
Ultra-dominant
La loi sur le DMA (Digital Market Act), initialement destiné à atteindre ces objectifs, a largement ignoré les pratiques déloyales en matière de licences de plusieurs contrôleurs de logiciels, malgré de nombreux amendements du Parlement européen. « La Commission européenne a désormais le pouvoir de préciser le DMA par un acte délégué. La première action devrait être d'utiliser ce pouvoir pour interdire aux contrôleurs d'accès ultra-dominants de discriminer les concurrents par le biais de licences logicielles déloyales dans le secteur de l'infrastructure cloud. »
En outre, le projet de loi sur les données de l'UE jette des bases importantes pour lutter contre les pratiques anticoncurrentielles et les pratiques contractuelles déloyales en matière de logiciels dans le cloud. « Cependant, si des licences logicielles déloyales continuent d'empêcher les clients du cloud de transférer des logiciels sous licence vers des services cloud concurrents, les objectifs de la loi sur les données visant à promouvoir la portabilité et l'interopérabilité sont au mieux un vœu pieux. »
Apprendre de l'expérience
Dans un deuxième temps, le Parlement européen et les États membres doivent résister au lobbying des éditeurs de logiciels dominants, qui dilue le contenu proconcurrentiel de la loi sur les données.
Troisièmement, le Commissaire européen Thierry Breton promeut déjà activement un IPCEI (Important Project of Common European Interest) dans ce domaine. La participation de nombreuses entreprises est d'un intérêt vital pour renforcer la position de l'Europe dans les futures technologies du cloud.
Quatrièmement, la récente plainte pour concurrence du CISPE devrait rapidement conduire à une enquête formelle de la Commission européenne.
Licence logicielle équitable
« Mon espoir est d'apprendre de l'expérience : j'ai souvent vu que des dommages irréversibles étaient causés par des procédures prolongées avant même que les mesures puissent prendre effet. »
Enfin, tous les fournisseurs de logiciels et de services cloud doivent s'engager à respecter les dix principes pour une licence logicielle équitable proposés par le CISPE et l'association française CIGREF.
Pour les entreprises du secteur numérique, qui regroupe aujourd'hui pratiquement toutes les entreprises, le respect de ces principes est tout aussi important que l'engagement envers les objectifs européens dans les domaines de l'environnement, du social et de la gouvernance d'entreprise responsable. « Seuls ceux qui veulent fausser la concurrence ont quelque chose à perdre. »
