LE PROJET DE RÉFORME DES DROITS D'AUTEUR DU MINISTRE VAN PETEGHEM MENACE LE SECTEUR IT. S'IL ABOUTIT, IL METTRA EN DIFFICULTÉ NOS ENTREPRISES ET FERA FUIR NOS TALENTS.
Nos développeurs informatiques ne pourront-ils plus faire valoir leurs droits d'auteur ? Nos informaticiens ne seraient-ils plus des auteurs à part entière ? Jusqu'ici, aux yeux de la loi, la création de tout ou partie d'un programme informatique répond aux critères de droits d'auteur, y compris les travaux préparatoires, les éléments graphiques, l'architecture du programme, les diagrammes de flux bénéficient du régime des droits d'auteur. Mais sans doute plus demain.
Dans le projet du ministre des Finances Vincent Van Peteghem (CD&V), qui vise à introduire un ratio de droits d'auteur admissible par rapport aux revenus professionnels, les développeurs IT sont tout simplement exclus. Un non-sens économique. Maintenant que la récession menace, il faut pouvoir garder les coûts sous contrôle, en particulier ceux liés à la masse salariale. Or, dans l'IT, ceux-ci représentent grosso modo 80% du total…
UN COUP DE FREIN AUX EMBAUCHES
Odoo, par exemple, qui compte 400 personnes en R&D, a calculé que la suppression de ce régime aurait un impact clair de 5 à 10 millions EUR… qu'il lui faudrait dès lors compenser avec du brut. Mais plus fondamentalement, cela aurait aussi et surtout pour conséquence de donner un sérieux coup de frein aux embauches. Et donc endiguer la croissance. Quid, en janvier prochain, quand l'indexation des salaires de 10% pointera son nez ?
Le droit d'auteur est crucial pour les métiers de l'informatique. D'autant que le secteur IT n'est pas sans défis. Il connaît déjà une pénurie marquée de talents, qui sera encore accentuée si le projet passe… Dans une récente enquête sur le sujet, le spécialiste du recrutement Robert Half montrait que pour 25% des CIO belges, la gestion des talents sera la principale priorité au cours de l'année à venir. De même, un CIO sur quatre cherchera à pouvoir continuer à payer un salaire compétitif à long terme. De là, l'évolution du nombre de contre-offres pour retenir leurs talents. Le paiement des droits d'auteur en fait partie.
IMPOSER UN MAXIMUM DE 30% DES REVENUS ATTRIBUÉS À L'INNOVATION
Ne rêvons pas. S'il y a réforme, le système sera contourné. Le pays y perdra. En effet, les alternatives au départ du travail à distance depuis d'autres pays ne manquent pas. Les entreprises les plus structurées en seront les premiers bénéficiaires… En revanche, il sera de plus en plus difficile de retenir les développeurs en Belgique, le net n'étant plus compétitif. Et là, le coup de frein sera brutal.
Le gouvernement devrait soutenir les secteurs porteurs d'emploi. Or, là, il les plombe. Imposer un maximum de 30% des revenus attribués à l'innovation -aux artistes comme aux développeurs- serait une piste. Elle a été évoquée par l'industrie. C'est, à tout le moins ,une proposition équilibrée, préservant la motivation à investir et engager.
